    Malaba Deputy Headteacher Convicted of Indecent Acts on Pupils

    A deputy headteacher in Malaba, Busia County, has been found guilty of committing indecent acts against pupils.

    The teacher faced 10 counts, including indecent acts with a child under Section 11(1) of the Sexual Offences Act and promoting sexual offences with a child under Section 12(b).

    The offences included forcing minors to masturbate, exposing them to pornography, and engaging them in sexually suggestive conversations during school hours.

    The prosecution, led by Tonny Rotich, presented 13 witnesses—boys aged between 14 and 17—who testified about repeated abuse inside classrooms. They revealed how the teacher showed them pornographic videos on his phone before touching them inappropriately within the school compound.

    Forensic evidence confirmed that the teacher’s phone contained pornographic content accessed during the period in question.

    Although the defense attempted to discredit the witnesses and pointed to procedural issues, it failed to counter the main allegations.

    The court convicted the teacher on Counts 2, 3, 5, and 6 for indecent acts with minors, and Count 4 for promoting sexual offences by exposing a child to pornography.

    In its ruling, the court stated that minor inconsistencies or lack of physical evidence do not outweigh credible testimony, especially from children. It also rejected claims of witness coaching or institutional bias, affirming that judicial findings stand independent of administrative decisions.

    Sentencing will be delivered on October 16, 2025.
