A legal showdown is brewing between County Assembly Speakers and the Salaries and Remuneration Commission (SRC) after the speakers moved to the High Court demanding hefty car grants and maintenance allowances.
In a petition filed on Tuesday, the speakers are seeking an order compelling SRC to allocate each of them a Sh5 million car grant and a Sh200,000 monthly vehicle maintenance allowance, citing what they term as “gross discrimination” in comparison to their counterparts in the executive and legislature.
Speakers Cry Foul Over ‘Unfair Treatment’
The County Assembly heads argue that governors, MPs, and senior government officials enjoy luxurious benefits, yet they, as the heads of county legislatures, are being sidelined. “It is absurd that we are expected to execute our duties effectively without proper facilitation,” one of the petitioners stated.
The speakers claim the SRC has failed in its constitutional mandate by denying them what they believe to be their rightful benefits. “We oversee legislative matters at the county level, but we are treated as second-class leaders,” another speaker lamented.
SRC’s Stand: ‘Unrealistic Demands’
The SRC, on the other hand, has maintained that the request is unjustifiable and unsustainable in the current economic climate. An official from the commission, speaking on condition of anonymity, stated, “The government is already struggling with a ballooning wage bill. Approving such benefits would be fiscally irresponsible.”
The commission insists that county assembly speakers already receive adequate salaries and allowances and that their demand for additional perks would create a dangerous precedent that could cripple county budgets.
Public Outrage Over Extravagant Perks
The lawsuit has sparked mixed reactions, with many Kenyans expressing outrage over what they perceive as extravagant and unnecessary perks. “This is pure greed. County Assemblies are struggling with development projects, and instead of fighting for funds to help the people, they are chasing luxury benefits,” said a political analyst.
On social media, critics have accused the speakers of misplaced priorities. “Hospitals lack medicine, roads are in terrible condition, and these leaders are fighting for millions for cars?” a Twitter user posted.
Political Implications
The case could have major political ramifications, especially in counties where MCAs and governors are at loggerheads. If the court rules in favor of the speakers, it may embolden other county officials to demand similar benefits, putting further strain on public resources.
Legal experts say the case could drag on for months, with the High Court set to give directions on the matter in the coming weeks. Meanwhile, all eyes remain on the judiciary, SRC, and county governments as Kenyans brace for yet another battle over public funds.
