    In a gripping courtroom saga unfolding in Kahawa Wendani, bartender Mary Mwende has found herself at the center of a contentious legal battle. She is fighting for a share of estates worth over Ksh. 100 million left behind by two deceased businessmen, Andrew Wanyoike Muthee and Geoffrey Kinyua Mwangi, both of whom she reportedly cohabited with before their deaths.

    The widows of the two men, however, have challenged Mwende’s claims, accusing her of manipulating their husbands for financial gain and seeking to exploit Kenya’s inheritance laws to access wealth she is not entitled to.

    The dispute traces back to 2019, when Wanyoike, a wealthy entrepreneur, separated from his wife and began living with Mwende. He died two years later under unclear circumstances, leaving a substantial estate that included properties and thriving businesses.

    Barely a year after Wanyoike’s death, Mwende began cohabiting with Kinyua, a close acquaintance of Wanyoike, who also separated from his wife to be with her. Tragically, Kinyua passed away in 2023, further complicating the estate matters.

    Now, both widows have taken Mwende to court, claiming she manipulated their husbands during their moments of vulnerability to secure a claim to their fortunes. Mwende, on the other hand, has asserted her position as a legitimate partner to both men, stating that her relationships were genuine and deserving of recognition under Kenyan law.

    Courtroom Drama

    At the heart of the dispute is Kenya’s succession law, which recognizes dependents, including those in unregistered unions, as potential beneficiaries of an estate. Mwende argues that her cohabitation with the two men qualifies her as a dependent and therefore entitles her to a share of their estates.

    The widows, however, have dismissed these claims, labeling Mwende as a gold digger who leveraged the men’s separations to secure financial gain. They contend that she made no significant contributions to the acquisition or management of the estates and therefore has no legal basis to claim the wealth.

    Legal experts following the case have noted its potential to set a precedent in the interpretation of dependency under succession law, particularly for cohabitation relationships.
