    Dr. Augustus Kyalo Muli has moved to the High Court of Appeal in a bid to block the Wiper Party from replacing him as the representative of the Minority Coalition in the IEBC Selection Panel. This follows the High Court’s ruling on October 22, 2024, which annulled his nomination and ordered a fresh election within 24 hours.

    In the appeal filed by his lawyer, Kelly Malenya, Dr. Muli is challenging the court’s decision, arguing that the repeat election is illegal and denies the involved parties adequate notice to participate in a competitive process. He also claims that the original election result, which he won on July 26, 2024, has not been impugned or legally challenged.

    Malenya’s appeal raises concerns over the fairness of the repeat election, accusing the court of endorsing the nomination of Dr. Koki Muli, who had lost to Dr. Augustus Muli in the previous election. The appeal further highlights the urgency of the matter, stating that if the appeal is not heard promptly, the entire selection process for the IEBC commissioners could be marred by irregularities, potentially having serious consequences for the country’s electoral body.

    The appeal seeks to halt the fresh election and prevent Dr. Muli’s replacement until the matter is fully resolved in court. If the stay is not granted, Dr. Muli’s legal team argues, the appeal will be rendered irrelevant as the IEBC Selection Panel’s term is short, and the body may have completed its work by the time the appeal is heard.

    The case is set to attract significant attention as it could influence the composition of the IEBC Selection Panel, a critical body tasked with overseeing the recruitment of new electoral commissioners.
