Sarah Cohen to Remain in Custody as Court Denies Bail for Second Time

Sarah Wairimu Kamotho, the widow of slain Dutch businessman Tob Cohen, will remain in custody at Lang’ata Women’s Prison after the High Court in Kibera once again denied her request for bail.

Delivering the ruling, Lady Justice Diana Mochache cited the absence of any significant change in circumstances to warrant a review of the earlier decision denying bond. The court noted that concerns raised by the prosecution, including the risk of flight, potential witness intimidation, and interference with the crime scene, remained valid.

Acting Deputy Director of Public Prosecutions Vincent Monda led the prosecution’s opposition to the renewed bail application. He argued that Sarah Wairimu had previously tampered with the crime scene, attempted to intimidate witnesses, and fraudulently acquired a second passport while her original one remained in police custody—raising fears of her fleeing the country.

“The risk of interference with prosecution witnesses remains high,” ruled Justice Mochache, adding that the protection of witnesses and the integrity of the criminal justice process are paramount.

While denying bond, the court allowed Sarah Wairimu’s defense team to access the crime scene under strict supervision to safeguard potential evidence.

Sarah Wairimu is accused of murdering her husband, Tob Cohen, on July 19, 2019, at their home in the Lower Kabete area of Nairobi County. The case, which has attracted significant public and media attention both locally and internationally, continues to unfold six years after Cohen’s brutal killing.

The matter is scheduled for mention on July 30, 2025, for further directions.
