The High Court in Kitui has halted the suspension of Members of the County Assembly issued by the Speaker of the Kitui County Assembly last week.
In a ruling delivered on October 7, 2025, Justice Elizabeth Wairimu Karani issued conservatory orders stopping the Speaker from enforcing Communications No. 149, 150, and 151 of 2025, which had suspended Hon. Sylvester Munyalo Kitheka and Hon. Mathew Ngovi Vuthi, among others.
Reacting via a popular WhatsApp group shortly after the ruling, Matinyani MCA Sylvester Munyalo Kitheka welcomed the court’s decision, describing it as a victory for justice and democracy in Kitui. “Let your plans be dark and impenetrable as night, and when you move, fall like a thunderbolt,” he said, hinting that the battle was far from over and vowing to continue fighting for fairness and accountability within the County Assembly.
The court also directed that the affected MCAs continue enjoying all rights, privileges, and benefits of their offices and barred the Speaker from excluding them from Assembly Service Board meetings.
The petitioners had moved to court arguing that their suspension was illegal and politically motivated. The matter will be mentioned on November 25, 2025, to fix a date for judgment.
Any disobedience of the court order will attract penal consequences.
